These Terms of Service govern your use of Aperture Manila and its services. By accessing, browsing, or using our website, portfolio platform, and related services, you agree to be bound by these terms. We reserve the right to modify these terms at any time, and continued use of our services constitutes your acceptance of any changes.

Acceptance of Terms

Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms of Service. If you do not agree to abide by the above, please do not use this service. We provide our photography portfolio platform, full-bleed gallery features, lightbox overlays, and category filters to showcase creative work for Philippine studios and artists.

By using our platform, you acknowledge that you have read these terms, understand them, and agree to be legally bound by their contents. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

User Obligations

You agree to use our services only for lawful purposes and in ways that do not infringe upon the rights of others or restrict their use and enjoyment of our platform. Prohibited behavior includes harassing, causing harm to, or threatening others; transmitting obscene or offensive content; and disrupting normal flow of dialogue within our website.

Users uploading photography content to our platform agree that all images comply with applicable laws and do not violate any third-party intellectual property rights. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We ask that you notify us immediately of any unauthorized use of your account or any other breaches of security.

When using our category filters for travel, food, portrait, and event photography collections, you agree not to misrepresent the nature or content of your work. All uploaded images must be optimized appropriately for retina display delivery, and you assume responsibility for file quality and load time performance.

Intellectual Property Rights

Our platform, including all design elements, code, photography templates, lightbox overlays, and full-bleed gallery layouts, remains our intellectual property. You retain ownership of all original photography and creative content you upload to our services. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your work within our portfolio platform for promotional and demonstration purposes.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of our services, including design features, without our express written permission. This includes but is not limited to our responsive image optimization techniques, category filter systems, and transition animations.

All trademarks, logos, and service marks displayed on our platform are our property or the property of their respective owners. Nothing in these terms grants you a right or license to use any trademark, logo, or service mark without our prior written consent.

Limitation of Liability

We provide our services on an “as-is” basis without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, timely, secure, or error-free. Your use of our platform and services is at your own risk, and we disclaim all liability for damages arising from your use or inability to use our services.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services, including but not limited to loss of data, business interruption, or lost profits. This limitation applies regardless of the form of action and whether such damages arise from contract, negligence, strict liability, or any other legal theory.

While we optimize high-resolution image delivery for retina displays, we do not guarantee specific load times or performance metrics. We are not responsible for any loss of data or corruption of files resulting from platform use, server issues, or network failures beyond our reasonable control.

Termination of Services

We reserve the right to terminate or suspend your account and access to our services at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users, our business, or our reputation. Termination may result in the deletion of your account information and content.

Upon termination, your right to use our services ceases immediately. You remain responsible for all charges incurred prior to termination. We may retain backup copies of your data for a limited period as required by law, but we have no obligation to maintain your content after account closure.

You may request termination of your account at any time by notifying us through our platform settings or contact channels. Upon your request, we will make reasonable efforts to remove your personal information from our active systems, though some residual data may remain in backup copies in accordance with our data retention policies.
